ABSTRACT For several generations before the First World War, the idea that the British constitution contained a ‘right of asylum' for foreign nationals was commonplace. Though this belief had profound consequences for Britain's treatment of political and religious exiles, its relations with foreign states, and the drafting of its extradition and immigration laws, there has been little enquiry into its origins. This article delineates the emergence of the idea of a constitutional ‘right of asylum', locating it in a series of (...) political clashes over the ‘Alien Act' that took place during the decade after the Napoleonic Wars. This legislation, which established controls over foreigners during the French Revolution and the quarter-century of war that followed, was increasingly challenged by the Whig and radical oppositions after Waterloo, both for its specific arbitrary provisions and as a more fundamental violation of the rights of aliens guaranteed by key constitutional documents like Magna Carta and the Habeas Corpus Act. By the mid-1820s these objections cohered into a conviction that asylum itself could be claimed as a right. This conviction and the arguments that spawned it were repeated for many subsequent decades, forming the basis of the widespread Victorian belief in the ‘right of asylum’. (shrink)

Petr Jakovlevič Čaadaev (1794–1856) gehört zu den herausragenden Gestalten der russi-schen Kultur- und Geistesgeschichte. Seit seiner Zeit an der Moskauer Universität (1808–1811) interessierte er sich für Philosophie und für die Vermittlung von Wissen-schaft (Philosophie), Geschichte und Religion. Čaadaev kämpfte als Offizier der Kaiserlichen Garde gegen Napoleon, verzichtete aber 1821 freiwillig auf eine Offizierskarriere. Eine private Europareise (1823–1826) prägte sein Weltbild. In den Jahren 1828–1830 verfasste Čaadaev acht 'Philosophische Briefe' in französischer Sprache, die den geschichts-philosophischen Diskurs in Russland mitbegründeten. Nach (...) der Veröffentlichung des ersten Briefes (1836) erklärte ihn Zar Nikolaus I. für geisteskrank und erteilte ihm Schreib- und Druckverbot. In der Auseinandersetzung Westler/Slawophile spielte Čaadaev in den 1830/40er Jahren die Rolle eines Außenseiters, der sich als religiöser Westler weder der einen noch der anderen Seite anschloss. Penser la guerre, c'est se placer dans l'effort philosophique qui se conçoit comme élucidation et affirmation rationnelles des différentes manières dont l'option humaine pour la raison et contre la violence se réalise dans l'histoire. Cette thèse fournit le point de vue à partir duquel l'auteur épouse la pensée de Kant, von Clausewitz et Hegel, en essayant ensuite d'en tirer des leçons possibles en vue des discussions actuelles dans la philosophie politique en tant que réflexion sur la guerre et la paix. Von Clausewitz, penseur de la guerre après la « révolution » militaire depuis Napoléon, n'est pas seulement le « militariste » s'appliquant à la rationalité qui se déploie dans la violence guerrière elle-même, mais a surtout montré comment la guerre doit emprunter sa rationalité spécifique à la rationalité supérieure et englobante qui est celle de la politique , selon sa célèbre formule: la guerre est la continuation de la politique avec d'autres moyens. Mais il s'agit de bien comprenre cette formule. Dans la philosophie politique hégélienne, qui veut «saisir en pensée» le système d'une pluralité d'États indépendants et également souverains, la guerre a le caractère d'une «nécessité» rationnelle. Dans la philosophie du droit de Kant, la paix stable est l'objet d'un devoir impératif de la pure raison pratique, mais la guerre semble, de fait, inévitable, et ceci encore pour longtemps. C'est dans son projet philosophique intitulé Vers la paix perpétuelle que Kant essaie de penser les conditions politiques nécessaires pour établir une paix durable et juste entre les nations. L'auteur montre que ce projet est moins irréaliste qu'on ne le pense le plus souvent, si on veut l'interpréter à la lumière de la philosophie de l'histoire de Kant. On peut se demander néanmoins si Hegel ne continue pas à avoir raison contre Kant. Mais pour Hegel aussi l'histoire est un apprentissage. Au philosophe qui la comprend elle prouve, dit-il, la perfectibilité de l'éducation du genre humain. Il est possible de trouver, de ce point de vue, une convergence de la philosophie de l'histoire de Hegel avec celle de Kant. Une importance spécifique est donnée ici à l'interprétation du dictum de Hegel, que dans la guerre elle-même la guerre est déterminée comme devant être passagère . S'il est vrai que l'histoire de la dialectique de guerre et de paix peut nous rendre plus „sages”, qu'est-ce qu'elle nous a appris ? L'auteur souligne plus spécialement deux éléments: nous comprenons peut-être mieux la signification de la liberté et de ce qu'implique „libération”; nous voyons plus clairement l'importance à donner aux droits de l'homme comme expression de la justice. Il conclut que la philosophie comme „pensée de guerre” peut éclairer la politique dans son effort tendant à définir la justice qui peut établir la paix, afin de rendre superflue la guerre qui doit établir la justice. La traduction peut jouer un rôle fondamental dans la création des concepts philosophiques. C'est ce qui se passe depuis 1990 en Russie, après l'effondrement de l'idéologie soviétique. Mais le fait n'est pas radicalement nouveau. Dès l'époque de Pierre le Grand, Vassili Trediakovski travailla à créer en russe des concepts correspondant à ceux de la philosophie européenne. On rencontre un processus semblable à l'époque postnapoléonienne, ainsi qu'au début du XXe siècle. De nos jours, ce sont des auteurs comme Foucault, Derrida, Deleuze, (...) Lacan et Lyotard qui, chacun à sa manière, sont accueillis en Russie, où se créent ainsi des concepts philosophiques spécifiques. Translation may play a fundamental part in the creation of philosophical concepts. Such is what happens in Russsia since 1990 after the collapse of Soviet ideology. But the fact is not radically new. As early as Peter the Great times, Vassili Trediakovski worked at creating inRussian quite a few concepts corresponding to those of European philosophy. A similar process is also to he come across during the post-Napoleonic days and at the beginning of the 20 century. Presently, authors such as Foucault, Derrida, Deleuze, Lacan and Lyotard, every one in his own way, are welcomed in Russia where specific philosophical concepts are thus created. (shrink)

Classical science and in fact Post-Newtonian science up till the early twentieth century were mired in a deterministic interpretation of realities. The deterministic hypothesis in science holds that everything in nature has a cause and if one could know the antecedent causes, he could predict the future with certainty. But quantum mechanics holds that sub-atomic particles, though the ultimate materials from which all the complexity of existence in the universe emerges, do not obey deterministic laws, hence, their activities are causally (...) indeterminate and could only be understood with probability. This paper argues that quantum mechanics can not totally be free from determinism, for it has subtly conceded to determinism in holding that the sub-atomic particles are the building blocks of the macro world, and that there is interconnection between entities in the universe, even at the nonmanifest level. The probabilistic interpretation of quantum mechanics only betray our human limitation of the knowledge of nature, which, I believe still have lots of tricks in our sleeves over mankind. (shrink)

The question naturally arises: Is public art inherently violent, or is it a provocation to violence? Is violence built into the monument in its very conception? Or is violence simply an accident that befalls some monuments, a matter of the fortunes of history? The historical record suggests that if violence is simply an accident that happens to public art, it is one that is always waiting to happen. The principal media and materials of public art are stone and metal sculpture (...) not so much by choice as by necessity. “A public sculpture,” says Lawrence Alloway, “should be invulnerable or inaccessible. It should have the material strength to resist attack or be easily cleanable, but it also needs a formal structure that is not wrecked by alterations.”12 The violence that surrounds public art is more, however, than simply the ever-present possibility of an accident—the natural disaster or random act of vandalism. Much of the world’s public art—memorials, monuments, triumphal arches, obelisks, columns, and statues—has a rather direct reference to violence in the form of war or conquest. From Ozymandias to Caesar to Napoleon to Hitler, public art has served as a kind of monumentalizing of violence, and never more powerfully than when it presents the conqueror as a man of peace, imposing a Napoleonic code or a pax Romana on the world. Public sculpture that is too frank or explicit about this monumentalizing of violence, whether the Assyrian palace reliefs of the ninth century b.c., or Morris’s bomb sculpture proposal of 1981, is likely to offend the sensibilities of a public committed to the repression of its own complicity in violence.13 The very notion of public art as we receive it is inseparable from what Jürgen Habermas has called “the liberal model of the public sphere,” a dimension distinct from the economic, the private, and the political. This ideal realm provides the space in which disinterested citizens may contemplate a transparent emblem of their own inclusiveness and solidarity, and deliberate on the general good, free of coercion, violence, or private interests.14 12. Pendant près de deux siècles, la " question sociale"s'est confondue avec la question de la propriété, ou plus exactement avec celle de sa légitimité. Tel auteur affirme que c'est l'âme de la législation. Tel autre que c'est le vol. On dispute de ses origines et de ses limites, parfois de son abolition. Mais à travers la violence de la querelle, partisans et détracteurs de l'institution s'en font la même idée : un droit absolu d'une personne sur une chose. Or il (...) se trouve que cette définition, empruntée à la dogmatique juridique, est devenue largement inopérante. Les spécialistes préfèrent désormais parler de secret, d'exclusivité ou de faisceau de droits, et certains suggèrent même la " désintégration " de la propriété. Il reste que si un dogme propriétaire s'est désintégré, la chose elle-même, sous quelque forme que ce soit, se porte fort bien, et continue de poser d'épineuses questions de justice - sociale notamment. C'est dire que s'offre enfin la chance que soit posée, dans toute sa radicalité conceptuelle, la question de savoir ce qu'est la propriété. Pour y répondre, une enquête est menée dans ce livre aux sources du droit de propriété moderne, du côté des premiers commentateurs du Code Napoléon. Au-delà des déclamations idéologiques des préfaces, elle s'aventure là où opère vraiment la créativité conceptuelle des juristes, dans l'élément technique du droit. Il apparaît alors que la propriété désigne soit une maîtrise souveraine, droit réel et absolu de l'esprit sur la matière, soit l'appartenance patrimoniale, rapport d'identité pensé dans les termes de l'avoir, soit enfin une réservation de jouissance, monopole d'exploitation octroyé en rémunération d'une activité productrice de valeur. During his Chicago years, Dewey's interests led him not only into the field of philosophy but also into that of education, and in each of these areas he acquired a retmtation which placed him (...) among the top thinkers in the country. His work in philosophy resulted in his being acclaimed, along with Charles S. Peirce and William James, as one of the three great founders of American pragmatism, and his achievements in education led to his being regarded as one of the country's most outstanding educational thinkers and a prime mover in educational reform. The University of Chicago was only four years old when Dewey arrived there, but already it had attained a high standing among the universities of the country. The main reason for this was that the University had set out to be not simply another college but a university, like the universities in Europe and like Johns Hopkins and Clark universities in this country. This meant that the graduate schools of the University were to be stressed and that a large part of the faculty was to devote itself exclusively to graduate instruction and research. The type of faculty member the University looked for "must be a teacher, but first and foremost he must be a scholar, in love with learning, with a passion for research, an investigator who could produce, and if what he produced was worthy, would wish to publish." ~ In the four years since its founding, the University had assembled one of the most outstanding faculties in the country, a faculty which included: T. C. Chamberlin in astronomy, Rolin D. Salisburg in geology, Albert Michelson in physics, Jacques Loeb in biology, J. M. Coulter in botany, Thorsten Veblen in political economy, Albion Small in sociology, Paul Shorey in Greek, J. H. Breasted in Egyptology, and R. G. Moulton in English. "Those massive buildings, millions of money, thousands of scholars and scores of teachers," wrote one of his admirers, "are a monument to the foresight, nerve, and ceaseless activity of W. R. Harper, a veritable Napoleon in the educational field." 2 Born July 26, 1856, Harper was three years older than Dewey and every bit as precocious. He received his A.B. degree from Muskingum College when he was fourteen; he entered Yale as a graduate student when he was seventeen and got his Ph.D. degree from there at the age of nineteen. Upon receiving his doctorate, he began a career teaching Hebrew first at the Baptist Union Theological Seminary in Chicago and then, in 1886, at Yale. Harper wrote extensively on theological matters and his views prompted an attack on his orthodoxy in 1888. He weathered the storm, however, and throughout his life was a staunch defender of liberal theological thought. Harper had tremendous vitality and enthusiasm, and these qualities, along with his scholarship, led to his appointment as first president of the University when it was founded in 1890. Harper and Dewey were to have close associations on the administrative level, and though many of these were to be pleasant and cordial, others turned out to be not so harmonious and led eventually to Dewey's resignation from the University. In his recent work, David DeGrazia (2020) explores the possibility of insect sentience, focusing on bees as a case study. He advances a novel evolutionary approach, arguing that, from an evolutionary perspective, it’s more likely that bees are sentient than insentient., insofar as bees (allegedly) would have a selective advantage if they are motivated—in the form of feeling—to achieve their aims. His argument assumes two questionable claims: (1) if X is a selective advantage for an organism, then the organism likely (...) has X, and (2) conscious creatures would have a selective advantage if they are sentient. I challenge both claims, and consequently call into question DeGrazia’s claim that we have an evolutionary-based reason to attribute sentience to bees (and other insects). (shrink)

The goal of this study was to determine whether it is possible to teach children with serious decoding problems four text comprehension strategies in listening contexts. The subjects were 9-11 year old students from special schools for children with learning disabilities. All the students were very poor at decoding; half of the group were also poor listeners, whereas the other half consisted of normal listeners. The experimental children were trained in strategies of clarifying, questioning, summarising and predicting through a combination (...) of reciprocal teaching and direct instruction. The results indicated significant programme effects on a strategic listening comprehension test. A transfer effect on general listening comprehension and general reading comprehension tests was not found. I have been thinking of launching a similar parlour game called “Six Degrees of Bertrand Russell”, in which any Wgure from the past 200 years or so could be connected with Bertie in as few steps as possible. Why Bertie rather than, say, Ludwig Wittgenstein (who after all had a stated interest in games)? For two reasons: Wrst, Russell lived to the ripe old age of 97, and thus had the time to interact with a wide variety of people; and secondly he was for most of that long life a celebrity, who rubbed elbows with all manner of individuals, many of whom were either celebrities themselves at the time or came to be celebrated later. As is often pointed out, Russell’s list of acquaintances stretched from Lenin (V.yI.) to Lennon (zJohn), from the Bloomsbury Group to the Doomsday Prophets, from William Gladstone to Harold Wilson. Russell’s grandfather, LordJohn Russell, had as a young man visited Napoleon on the island of Elba and shaken his hand. These surviving spouses, partners, relatives, and friends, in addition to coping with the death of a loved one, must also deal with the loved one's decision to die, thus severing the relationship. C. G. Prado examines how reactions to elective death are influenced by cultural influences and beliefs, particularly those related to life, death, and the possibility of an afterlife.
